1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Qeja Real Estate Management ("Qeja", "we", "us", or "our"). By creating an account, accessing, or using our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

Qeja provides a cloud-based real estate management platform that enables:

• Property Management: List, manage, and track properties
• Tenant Management: Handle tenant applications, leases, and communications
• Financial Management: Process rent payments, invoices, and financial reporting
• Maintenance Tracking: Log and manage property maintenance requests
• Document Management: Store and organize property-related documents
• Analytics: Access insights and reports on property performance

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our services. By registering, you represent that all information you provide is accurate and complete.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

3.3 Account Types

We offer different account types including individual accounts, organization accounts, and platform administrator accounts. Each type has specific features and permissions as described in our platform documentation.

4. User Responsibilities

When using our services, you agree to:

• Provide accurate and truthful information about properties and transactions
• Comply with all applicable laws and regulations related to real estate
• Respect the rights and privacy of other users
• Not use the platform for fraudulent or illegal activities
• Not attempt to circumvent security measures or access unauthorized areas
• Not upload malicious content, viruses, or harmful code
• Not infringe on intellectual property rights of others

5. Prohibited Activities

You may not use our services to:

• Post false, misleading, or fraudulent property listings
• Discriminate against tenants based on protected characteristics
• Harass, threaten, or harm other users
• Collect or harvest user data without authorization
• Interfere with the proper functioning of the platform
• Violate any applicable real estate laws or regulations
• Engage in money laundering or other financial crimes

6. Content and Data

6.1 Your Content

You retain ownership of content you upload to the platform (photos, documents, property descriptions). By uploading content, you grant us a license to use, store, and display this content as necessary to provide our services.

6.2 Content Standards

All content must be accurate, legal, and not infringe on third-party rights. We reserve the right to remove content that violates these Terms.

6.3 Data Backup

While we maintain robust backup systems, you are responsible for maintaining your own copies of important documents and data.

7. Fees and Payment

7.1 Subscription Fees

Certain features require a paid subscription. Fees are billed according to the plan you select and are non-refundable except as required by law.

7.2 Payment Processing

Payment processing is handled by third-party providers. By making payments, you agree to their terms and conditions.

7.3 Changes to Fees

We may change our fees with 30 days' notice. Continued use after fee changes constitutes acceptance.

8. Intellectual Property

The Qeja platform, including its design, features, and content (excluding user-generated content), is owned by Qeja and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary materials without permission.

9. Third-Party Services

Our platform may integrate with third-party services (payment processors, mapping services, etc.). Your use of these services is subject to their respective terms. We are not responsible for third-party services or content.

11. Limitation of Liability

To the maximum extent permitted by law, Qeja shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from unauthorized access to your account
• Issues arising from third-party services or content

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Qeja, its officers, employees, and partners from any claims, damages, or expenses arising from your use of the platform, violation of these Terms, or infringement of any rights of third parties.

13. Termination

13.1 By You

You may terminate your account at any time through your account settings or by contacting support.

13.2 By Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason with notice.

13.3 Effect of Termination

Upon termination, your right to use the platform ceases. We may retain certain data as required by law or for legitimate business purposes.

14. Dispute Resolution

Any disputes arising from these Terms or your use of our services shall be resolved through:

1. Good faith negotiation between the parties
2. Mediation if negotiation fails
3. Binding arbitration as a last resort

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to conflict of law principles.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or platform notification. Your continued use after changes take effect constitutes acceptance of the modified Terms.

17. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Qeja
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect
• Waiver: Failure to enforce any right does not constitute a waiver
• Assignment: You may not assign your rights under these Terms without our consent
